This notice is addressed to all contacts of American Tower: suppliers, landlords, customers/prospects, employees, and other individuals whose personal data American Tower receives. It applies solely to activities for which American Tower is the data controller or processor, in accordance with applicable law.

What Legislation Applies?

American Tower is subject to the rules of various jurisdictions in which it processes personal data, including but not limited to the Massachusetts Data Privacy Act, the General Data Protection Regulation (GDPR) 2016/679 of April 27, 2016 (directly applicable from May 25, 2018), and the California Consumer Protection Act (CCPA).

What data is collected?

The data collected by American Tower is limited to the data necessary for the purposes pursued, as described below. This data may include, but is not limited to: identification and contact data (name, first name, business and/or personal address, date of birth, phone number, email address, and other available contact details of the concerned individuals), data related to business relationship tracking, financial and economic status, transactions and payment methods, invoice payment, your feedback on American Tower's products and services, and data resulting from the exercise of your rights. This personal data may also be used for prospecting and creating a database to offer potential landlords related to ATC France's activities and may be shared with third parties responsible for carrying out these tasks.

  • Additional Data Collected Specific to Customers/Prospects: Data related to business relationship tracking, financial and economic status, transactions and payment methods, invoice payment, feedback on our company's products and services, and data resulting from the exercise of your rights.
  • Additional Data Collected Specific to Suppliers: Data related to your professional activity, economic/financial information (including billing and payment data), location data, and connection data.
  • Additional Data Collected Specific to Individuals Involved in a Procedure with American Tower: Data related to that procedure.
  • Additional Data Collected Specific to Employees: Identity and information to identify or contact them, professional activity (job title, professional background, training received, etc.), payroll management data, work organization data (professional agenda, internal directories, organizational charts, etc.), connection data to the various information systems provided for their professional activities, and the use of professional tools (IP address, work phone, email, etc.).
  • Additional Data Collected Specific to Prospects and Landlords: Identification and contact data (name, first name, business and/or personal address, phone number, email address). This data is intended for prospecting and creating a database to offer proposals related to ATC France's activities that may be of interest. They may be shared with third parties responsible for carrying out these tasks.

What are the Purposes and Legal Bases for Processing Personal Data?

Generally, personal data is processed by American Tower in the context of managing administrative or commercial operations related to its relationships with landlords or employees. These purposes are common to all interlocutors and are in addition to the following specific purposes for certain categories of individuals:

  • Specific Purposes Related to Customers/Prospects: Operations related to customer management; management of access, rectification, and opposition rights requests; conducting studies, tests, and commercial statistics; managing feedback on our services; managing unpaid invoices and disputes.
  • Purposes Related to Ongoing Disputes with American Tower: Managing procedures related to criminal offenses or convictions or security measures, specifically preparing, exercising, or following up on disciplinary action or legal proceedings, and, if necessary, executing the resulting decision.
  • Purposes Related to American Tower Employees: The recorded information is used for managing employment contracts and their employment within American Tower, specifically for the following necessary purposes: administrative personnel management, providing IT tools, work organization, career management and mobility, and training. The processing carried out by American Tower is either (i) necessary for the performance of a contract or to take measures at the request of the individual concerned before entering into a contract, (ii) based on your prior consent, or (iii) necessary for compliance with a legal obligation to which American Tower is subject. Without this processing, the aforementioned actions could not be properly implemented by American Tower.

Data Recipients

Only recipients duly authorized by American Tower due to their functions will have access to the personal data concerning you, without prejudice to their possible transmission to bodies responsible for a control or inspection mission in accordance with applicable regulations. These recipients include authorized persons responsible, as appropriate, for purchasing, marketing, commercial, administrative, accounting, and IT functions, as well as those in charge of customer relations.

Is personal data shared internationally?

Due to American Tower's global presence, certain personal data processed is shared outside of its country of origin, including data from the European Economic Area with the United States. This sharing is carried out within the necessary limits to achieve the aforementioned purposes and in compliance with applicable regulations.

Non-disclosure of data

American Tower does not sell, rent, share, or disseminate the collected personal data to third parties, including providers or other partners, unless required by applicable law. However, this data may occasionally be transmitted to third parties in accordance with the purposes for which it was collected. When the disclosure of personal data to third parties is necessary for these purposes, American Tower ensures, as the data controller, that these third parties provide the same level of protection for the concerned data as that offered by American Tower, and requires contractual guarantees that, among other things, the data will be processed exclusively for the purposes previously authorized by you, with all necessary confidentiality and security.

Is personal data stored securely?

We implement technical and organizational measures to ensure that your personal data is stored as securely as possible for the time necessary to achieve the pursued purposes in accordance with applicable law. Specifically, for customers and prospects, the data is deleted, for commercial prospecting, no later than three years after the end of the business relationship between your company and ATC France (or their collection for prospects), subject to shorter periods provided by applicable law depending on the types of data and purposes. For suppliers and individuals involved in procedures, under the same reservation, the data is deleted no later than the end of your business relationship with ATC France. For employees, personal data will be deleted no later than after the employee leaves the company, subject to legal obligations and the possibility of archiving certain data. Exercising your rights regarding your personal data

American Tower will do its best to respond to your request as soon as possible and in any event within thirty (30) days of receiving your request. If necessary, this period may be extended, considering the complexity and number of requests. Additionally, under applicable regulations, you have the right to file a complaint with the competent supervisory authority.

Applicable law and competent court

This privacy policy and personal data protection policy is governed by French law. In the event of a dispute and in the absence of an amicable agreement on the subject matter herein, the competent court will be determined according to the applicable procedural rules.
